The original version of Arkansas's cottage food law, which was enacted in 2011 (Act 72), has been revised three times since then (2017 Act 399, 2019 Act 775, and 2021 Act 306).

But in 2021, Arkansas repealed their cottage food law and replaced it with the Food Freedom Act (SB 248), which is now considered to be one of the most progressive laws in the entire country.

In accordance with the food freedom law, producers are permitted to sell their home-prepared food virtually anywhere, including sales made through the distribution channels of grocery and retail outlets. Even sales over state lines are permitted.

Although producers are allowed to sell nearly any form of nonperishable food, those that sell acidified goods (like pickles, for example) are subject to additional regulations and must comply with them.

There is no cap on the amount that can be sold, and a producer is exempt from the requirement to obtain a permission from the health department. The food freedom law expressly forbids state and municipal governments from imposing restrictions on individuals who make their own food at home.
